Appeal from a judgment of the superior court for Chelan county, Steiner, J., entered August 25, 1906, in favor of the plaintiff, after a trial before the court upon an agreed statement of facts, in an action for conversion.

This is an action brought by the plaintiff as the sole surviving member of the Charles A. Andrus Company, a copartnership, to recover for the alleged conversion of a car load of powder, shipped to the said company from Black Biver, Washington. The case was tried upon an *334agreed statement of facts. The facts are in substance as follows:
