Error to Huron; Beach, J. Ejectment by the people against Hulbert H. Warner and John D. Weeks. Prom a judgment for plaintiff on verdict directed by the court, defendants bring error.

1Opinion of the CourtHooker, J.

In 1853 there existed in Saginaw Bay an island called “Maisou,” which had never been surveyed. In that year a- survey of this island was made by the government, and it was sold in 1868. A copy of the plat which was made by the surveyor is attached to this opinion,1 whereby it is shown that the surveyor found land lying to the eastward of Maisou island, which, he denominated “Wet Marsh,” and apparently did not survey.
