Before the Court are defendants’ motion to dismiss or for summary judgment, 1 plaintiff’s opposition thereto, numerous supplemental memoranda, and the entire record herein, the Court having heard argument and taken evidence on the questions presented. As the basis for their motion, defendants contend that plaintiff is not the real party in interest to this action.
