A jury verdict for defendant-appellant, Edward Rodriguez, resulted from an action brought under what is commonly known as the “Guest Statute,” section 320.59, Florida Statutes, F.S.A., for bodily injuries to plaintiff-appellee, Maria Gonzalez, the passenger. Upon motion of plaintiff, the court below entered an order granting a new trial; this appeal is the product of that order.
