CURTIS, Circuit Justice.
This is an appeal from a decree of the district court, sitting in admiralty. [Unreported.] The libel alleges that in August, 1850, the libellant caused to be shipped on board the hark Empress, Leet, master, belonging to the respondents, then lying at Havana, in the island of Cuba, 1,58S boxes of sugar, of the value of forty thousand dollars, to he carried to Boston, and delivered to tho libellant, for an agreed freight.
