This is an action for equitable relief brought by the plaintiff against defendant. From the allegations of the complaint it appears that on December 24, 1898, W. A. Wall, of Marion county, in consideration of the sum of $275, sold and conveyed to R. L. Montague and his assigns all the timber above 12 inches stunipi diameter, 12 inches from the ground at the time of'cutting, on a tract of 208 acres.
