The facts which are material on this appeal are not in dispute; and, as there is no bill of exceptions, the issues raised by appellant as to whether the judgment, in so fair as it dismisses the complaint against the respondent, Herman R. Johnson, — is warranted by facts found by the court, must be determined, as appellant contends, upon such matters of fact as are stated in the court’s findings. Bobczyk v. Integrity Mut. Ins.
