OPINION
CEDARBAUM, District Judge.
Plaintiff Norman I. Becker sues the City-University of New York (“CUNY”) for age discrimination in violation of the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621 et seq. Earlier this year, the United States Supreme Court held that the Eleventh Amendment of the Constitution bars a suit in federal court under the ADEA by a private individual against a state. Kimel v.
