Appeal from Livingston Circuit Court. — Hon. Francis H. Trimble, Judge. The court submitted the cause to the jury upon the first count of the information. Upon examination of the first count of the information, we find that the ownership of the goods and chattels were alleged to be and belong to “The Chicago, Burlington & Quincy Railway Company.” It is not alleged whether “The Chicago, Burlington and Quincy Railway Company” is a copartnership or a corporation.

Appeal from Livingston Circuit Court. — Hon. Francis H. Trimble, Judge. The court submitted the cause to the jury upon the first count of the information. Upon examination of the first count of the information, we find that the ownership of the goods and chattels were alleged to be and belong to “The Chicago, Burlington & Quincy Railway Company.” It is not alleged whether “The Chicago, Burlington and Quincy Railway Company” is a copartnership or a corporation. Upon a criminal charge hereinafter set ont by a count of the information to be quoted, the defendant was found guilty, and his punishment fixed at two years in the penitentiary.
