On August 28,1876, a judgment was rendered by the superior court of Taliaferro county in favor of T. M. Bryan, as administrator of the estate of J. B. Hart, against AtealomJL Evans. This judgment and the execution issued ihereon were subsequently assigned to John C. Hart. A constitutional homestead, containing 307 1/2 acres of land in that county, was, in August, 1877, duly set apart to Evans as the head of a family consisting of his wife, Mary E., and several minor children.
