OPINION

KAPLAN, District Judge.

This is a copyright infringement case. Plaintiff Infinity Broadcasting Corporation (“Infinity”) owns and operates radio stations and claims copyright protection for all of its broadcasts. Defendant Wayne Kirkwood d/b/a Media Dial-Up operates “listen lines” through which subscribers can listen to radio broadcasts, including Infinity broadcasts, over the telephone. The service is marketed to radio stations, radio consultants, advertisers, performance rights organizations and others in the advertising and entertainment industries. Infinity seeks an injunction…
