ADKINS, Judge.

The absence of a sufficient record of the evidentiary basis for a circuit court’s exercise of its discretion under Rule 4-215(d) will control our decision in this waiver of counsel case. Petitioner David Grant was arrested and charged with possession of counterfeit goods with intent to sell, in connection with his possession of allegedly counterfeit compact discs and digital video discs. Grant appeared without counsel at trial in the Circuit Court for Baltimore City, and requested a postponement to enable him to seek representation from the Office of the Public Defender (“OPD”).…
