This is a diversity action for defamation and injurious falsehood. Plaintiff Peter *449Paul Biro was the subject of an article written by Defendant David Grann that appeared in the July 12-19, 2010 issue of the New Yorker magazine (the “Article”), published by Defendant Conde Nast, a division of Advance Magazine Publishers Inc.
