The prosecutor appeals as of right from the order dismissing this case, arguing that Midland Circuit Judge Thomas A. Beale erred in determining that the retrial of defendant was barred on double jeopardy grounds. We agree, and reverse.
On November 23, 1988, defendant was convicted by a jury of violating the statute prohibiting parental kidnapping and custodial interference, MCL 750.350a(l); MSA 28.582(1X1).
