Defendants appeal as of right

from a circuit court order granting plaintiff damages as compensation for defendants’ temporary taking of plaintiff’s property. Defendants argue that the trial court erroneously applied a tort-based calculation of damages, that the trial court erred in refusing to admit evidence of the fair market value of the property, and that they were denied a fair trial because insufficient time was allowed for discovery. Plaintiff cross appeals, arguing that the damages awarded are inadequate.…
