The testator, Edward N. Morse, at his death, December 23,1889, left as his only heirs at law three sons, Edward J. W. Morse, Alfred B. Morse, and Justin N. Morse, and three *43daughters, Caroline A. Tower, Gertrude B. Belcher, and Florence W. Morse apparently by a subsequent marriage Florence W. Wells. Edward J. W. Morse died in 1906, and Justin N. Morse in 1920. The plaintiff, having been appointed executor of Justin’s will as well as trustee under the residuary clause, asks for instructions in its capacity as executor concerning the disposition of “certain rentals collected from Easton and…
