The parties will be referred to as they appeared in the court below, the appellees as plaintiffs and appellant as defendant. The action was originally brought on the law side of *268the court to recover damages for Breach of warranty of title to certain lands in the state of Missouri. The damages claimed were for failure of title to 58 acres, alleged to be of the value of $100 an acre, 2 acres, of the alleged value of $150 an acre, and 9 acres, alleged to be of the value of $100 an acre, of the total value of $7,000.
