This is an action for breach of a contractual obligation to drill the second of two exploratory oil wells in Ness County, Kansas. A claim in the second count of the petition was dismissed by plaintiff as shown in the pre-trial order. Therefore, we are not concerned with this claim of fraud against John Volosin, president of the Aspen Drilling Company, a corporation. The claim for damages arising from the breach of the drilling agreement was tried to the court and judgment was entered in favor of the defendant, Aspen Drilling Company (Aspen).…
