The defendant, Nicholas Miniero, charged with possession of burglar’s tools (Penal Law § 140.35), petit larceny (Penal Law § 155.25), and criminal trespass in the third degree (Penal Law § 140.10 [a]), moves for dismissal of the accusatory instrument on speedy trial grounds pursuant to CPL 30.30 (1) (b). The charges are contained in a prosecutor’s information which was filed pursuant to a Grand Jury directive (see, CPL 190.70).
