From an order sustaining a demurrer to the petition, plaintiff brought error on the transcript of the record, and S. C. Boswell appeared specially and moved to dismiss the appeal.

This is an appeal upon transcript of the record from the action of the court below in sustaining demurrer of defendants in error, defendants below, to the petition of plaintiffs in error, plaintiffs below, and S. C. Boswell.has appealed specially and filed motion to dismiss this appeal on the ground that he, being one of the defendants in the court below, was not made a party to the appeal and service had upon him.
