Plaintiff Anthony Venturino (‘Venturino”) commenced a civil action in the New York State Supreme Court, New York County (the “State Court”) under New York General Business Law § 349 (“§ 349”). He alleges deceptive acts relating to the marketing and issuance of certain disability insurance policies 1 by defendants First Unum Life Insurance Company and UnumProvident Corporation (collectively, “Defendants”).
