This suit grew out of a contract for the building of a residence on a lot owned by Mrs. 'Edna Earl Parsons, located near the city limits of Vicksburg’, Miss. The appellee Mrs. Parsons filed a bill of complaint in the chancery court of Warren county against J. W. McNeill, contractor, the United, States Fidelity & Guaranty Company, as surety on the building contract, and several ma-terialmen who furnished material for the construction of the said residence and who were asserting their claims against the said appellee and. the surety.
