Covenant, upon a contract in writing, whereby T. and D. Morgan, who were the defendants below, agreed to furnish at their distillery in New-Lawrence-burgh, to Hobbs and Stevenson, the appellees, the slop of *1700ne hundred and fifty bushels of corn per day, for the space of one year, to commence on the 1st of March, 1851, Sundays excepted; also excepting unavoidable accidents.
