Error to the circuit court of Yazoo county. Hehey, J. John Cotton, the plaintiff in error, was indicted in the circuit court of Yazoo county, for the murder of one John Smith. At the February term, a. d. 1854, of said court, he was tried and convicted of murder, and sentence of death pronounced against him, which judgment this court, on a writ of error, reversed, and awarded the prisoner a new trial.

Thé prisoner having been convicted at the last November term of the circuit court of Yazoo county, of the crime of murder, has brought this case for revision into court.
The errors assigned relate :—First. To the action of the court *920in empanelling the jury by whom the prisoner was tried. Second. To the instructions given on behalf of the state; to certain modifications of the instructions asked on behalf of the prisoner; and, Third.
