By a letter dated December 1, 1897, the defendant Francis Willey, engaged at Bradford, England, in the purchase and sale of wool throughout the world, (1) appointed the plaintiff his agent for the sale and purchase of wool in the United States and Canada, and (2) agreed that in addition to the fixed salary there stated, "You shall receive a bonus of 5% on the net profits realized from the sale and purchase of wool by my firm ... so long as you remain my agent only.” The letter further stated: "In ascertaining the realized profits on wools before mentioned, of which you will participate to the…
