Plaintiffs in error, who were plaintiffs in the trial court, brought this action against defendants in error, as defendants, to recover certain lands that had been set apart as the distributive share of the lands of the Seminole Tribe falling to Lewis Cox, a duly enrolled full-blood Seminole citizen, who died intestate on July 4, 1901, before selecting his allotment. At the time of his death he was lawfully married, and was survived by his wife, Annie, and two daughters, Maggie Beamore and Nancy Alexander, who are the plaintiffs herein.
