Affirming.
On May 7, 1926, Clyde Green shot and killed Joseph Allen. Clyde Green and his father, George Green, were jointly charged by indictment with mnrder. Separate trials were asked, under section 237 of the Criminal Code. The commonwealth elected to try Clyde Green. He was convicted of manslaughter, and his punishment fixed at confinement in the penitentiary for 21 years.
