MEMORANDUM AND ORDER
VAN ANTWERPEN, District Judge.
I. INTRODUCTION
On November 19,1988 Anthony Pungitore, Jr. was convicted by a jury in a major mafia trial of RICO and RICO Conspiracy, 18 U.S.C. §§ 1962(e), 1963. The jury specifically found him guilty of ten RICO predicate acts including one murder, two attempted murders, and three conspiracies to commit those murders. Post verdict motions were denied, and he was sentenced to a thirty year term of imprisonment on May 1,1989. United States v. Scarfo, 711 F.Supp. 1315 (E.D.Pa.1989).
