Bankruptcy petitioner Herman Segal (“Appellant”) moves pursuant to 28 U.S.C. § 158(a) to appeal an order by the United States Bankruptcy Court for the Eastern District of New York denying Appellant’s motion to dismiss the bankruptcy case. Richard O’Connell, the Chapter 7 trustee of Appellant’s estate (“Appellee”), opposes the motion on the ground that this court lacks jurisdiction to entertain the appeal.
