September, 1899, Hegeman & Company, consisting of Hegeman & Russell, contracted with the United States to build a dam at Herr’s island on the Allegheny river, and the same month gave bond to the United States with the American Surety Company as surety, having among others, a covenant to pay all persons for material and labor supplied in the work. Nicola Brothers supplied the timber necessary to the carrying out of the contract; the custom of dealing between them and the contractors, was for the latter to give their notes from time to time to Nicola Brothers for…
