The appellants Matthew Hill and his wife, Georgia Mae Hill, were convicted in the General Sessions Court for Greenville- County of the crime of assault and battery of a high and aggravated nature and each was sentenced to serve ten years and pay a fine of $10,000. They challenge their conviction and sentence upon the grounds that (1) their plea of former jeopardy should have been sustained by the lower court, (2) the lower court erred in refusing to instruct the jury that the failure of the State to call certain police officers as witnesses raised a presumption that their…
