The plaintiff, Shorr Paper Products, Inc., filed a three-count complaint in the circuit court of Kane County seeking to recover for damages sustained by a freight elevator in its building. Counts I and II sought recovery from defendant Reliance Elevator Company (Reliance), the company which originally installed and maintained the elevator.
