INTRODUCTION

In 1999, Gary W. Black was convicted of first-degree murder and sentenced to death. His conviction and death sentence were affirmed on direct appeal. State v. Black, 50 S.W.3d 778 (Mo. banc 2001). On appeal from the denial of Rule 29.15 post-conviction relief, this Court reversed. Black v. State, 151 S.W.3d 49 (Mo. banc 2004). On remand in 2006, Black was again convicted of first-degree murder and sentenced to death. Black appeals his conviction. This Court has exclusive jurisdiction of the appeal. Mo. Const, art.
