SPERRY, Commissioner.

Plaintiff sued defendant for damages which he suffered when he was injured while riding in a passenger automobile being operated by defendant. From a summary judgment in favor of defendant, plaintiff appeals.

Plaintiff pleaded that his injuries were suffered by reason of the negligence of defendant. The collision occurred within the intersection of highways 46 and 19, in the southeast part of the State of South Dakota, near Viborg. Defendant was proceeding north and became confused by reason of the highway-markings.. He slowed and stopped in order to determine which road…
