Appellant Harold Schmittinger instituted proceedings in the trial court seeking vacation, modification, and/or clarification of a 1970 order ratifying a separation agreement between himself and Ruby Schmittinger, his former wife. The wife, in turn, sought specific performance of the separation agreement, payment of arrears, and an increase in child support. The trial court found for the wife and the husband brought this appeal, arguing that the trial court erred in construing the terms of the separation agreement, in failing to bar the wife’s claims on the basis of…
