GARDNER, Circuit Judge.

This is an aetion on a poliey of life insurance upon the life of Bert Franklin Me-Elroy. It is alleged in the complaint that on the 2d day of April, 1928, the defendant, appellant in this court, issued and delivered to Bert Franklin McElroy a policy insuring his life in the sum of $10,000, naming the-plaintiff, Don Nettie McElroy, his wife, as the beneficiary in said policy, and that on the same day the! defendant company issued its supplementary contract insuring said Bert Franklin McElroy against-complete disability.
