BURKE, District Judge.

The plaintiff has a verdict for $77,000 for damages resulting from a fall into the hold of the merchant steam vessel “Sultana.” It was rendered in an action under the Jones Act, 46 U.S.C.A. § 688. The defendant has moved to set aside the verdict and for judgment in its favor in accordance with its motions for a directed verdict made at the end of the plaintiff’s case and at the conclusion of the evidence and in the alternative, for a new trial.
