I. Introduction

This adversary interpleader proceeding was commenced by a complaint filed October 7, 1992, in the United States Bankruptcy Court under Bankruptcy Rule 7022. Rule 7022 applies Rule 22 of the Federal Rules of Civil Procedure to bankruptcy adversary proceedings. 1 Plaintiff, Busch-Provo Limited Partnership (“Busch-Provo”), paid into the bankruptcy court approximately $27,000, which represents the amount due from the partnership to the holder of a 4% limited partnership interest.
