In this action for specific performance of a contract to sell real property the only issue presented is whether *655such property is or is not subject to a tenancy which will not expire until June 30,1945. The seller claims there is no tenancy for such term, a conclusion which his tenant disputes. On the basis of tenant’s contention the defendant purchaser has rejected the contract. The specific representation made by plaintiff (seller) in the contract of sale and accepted by defendant (purchaser) reads as follows: “ The above premises are sold subject to the tenancy of Jerome Moore, who is now…
