On June 23,1910, the common council of the defendant City of Portland commenced proceedings for the construction of a system of sewers in that city known as the “Riverside District Sewer,” and on or about July 1, 1911, preliminary assessment Ordinance No. 2306 was passed by the council attempting to make a proposed assessment on the property of the plaintiffs located in such sewer district. Objections were filed to such preliminary assessment and thereupon the proceedings were vacated and a reassessment allowed.
