On this appeal the Democratic National Committee (DNC) as an intervening defendant 1 challenges the district court’s determination that the plaintiff John B. Anderson (Anderson) “did not participate in the presidential primary election in North Carolina” within the meaning of N.C.Gen. Stat. § 163-213.6, and that he is, therefore, entitled to have his name placed on the November 4, 1980 general election ballot as the presidential candidate of the political party, Independents for Anderson Party of North Carolina.
