GARDNER, Circuit Judge.

Appellant, a national banking association, brought this action to recover taxes alleged to have been wrongfully exacted from it for the years 1919 to 1926, inclusive, hy the appellee county treasurer on shares of its stock at rates higher than were exacted of competing moneyed capital. It is alleged that competing moneyed capital was taxed for the years 1919 to 1923, inclusive, at the rate of three mills on the dollar, and for the years 1924 to 1925, inclusive, at the rate of four mills on the dollar, while the bank’s capital stock, surplus and undivided profits were,…
