Plaintiff in error brought suit to quiet title to a one-fourth interest in the waters of the Lock Ditch, No. 15, in El Paso County, including priorities Nos. 15, 22 and 43.

He alleged in his complaint that in 1879 one Mathias Lock was the owner of the said Lock Ditch, which he used to carry water for the irrigation of his land; that, in April of said year, said Lock sold an undivided one-half interest *594in said ditch and the water-right-'belonging thereto to one Owen and William A.
