This matter is before us on defendant-appellant’s appeal from a judgment of the Court of Common Pleas of Franklin County finding him guilty <of deception to obtain dangerous drugs in' violation of R.C. 2925.22 and sentencing him to six months to five years in prison.

Defendant, Mark C. Garrett, waived a' jury and agreed to a trial by stipulation of facts.
