There is presented to this court for review a judgment of the Court of Common Pleas of Hamilton county (based upon a verdict of a jury), which set aside and invalidated a paper writing which purported to be the last will and testament of Louis S. Peirano, deceased. The jury found and the judgment reflected that the deceased was without the required mental capacity to dispose of his property by will. The question decided was the sole issue in the case.
