Petitioner Texas Eastern Transmission Corporation (“TETCO”) appeals a decision by respondent Federal Energy Regulatory Commission (“FERC”) to apply the filed-rate doctrine to preclude TETCO from retroactively assessing certain customers (the “customers”) rates based on a different rate methodology than it previously imposed. 1 Some of these customers have inter vened ‘in this lawsuit to support FERC on appeal. 2 We affirm..
