FINDINGS OF FACT AND CONCLUSIONS OF LAW

DAVIS, District Judge.

C. Russell Danz and Charles E. Danz (“the plaintiffs”) instituted this action against defendants Cigna Corporation and Life Insurance Company of North America (“LINA”), seeking recovery of the proceeds of two life insurance policies in consequence of the death of their father. Plaintiffs filed the case in the Circuit Court for Anne Arundel County, from which the case was timely removed by defendants to this court on the basis of both diversity and federal question jurisdiction.
