I. INTRODUCTION
This matter is before the Court on cross-motions for summary judgment. The Board of Governors of the Federal Reserve System (the “Board”) has also moved to dismiss the case for lack of standing. The Court has accepted for filing the submission of the American Bankers Association (the “ABA”) as amicus curiae.
