WALKER, Chief Justice.
On the 3d day of March, 1933, in district court of Trinity county on trial to the court without a jury, appellee, the First National Bank of Groveton, recovered judgment against appellant, Bankers’ National Life Insurance Company, for the principal sum of $2,000, with 12 per cent, damages and $500 attorney’s fees, with interest at the rate of 6 per cent, per annum from the date of judgment. The judgment was rendered in appel-lee’s favor upon an insurance policy in the sum. of $2,000 issued by appellant to Winston Dial on the 15th day of December, 1931. The insured died…
