This appeal grows out of a suit in equity instituted by the plaintiff in the Court of Common Pleas of Allegheny County for the purpose of having a constructive trust impressed upon certain real estate situate in that county. Marie Moody, one of the defendants, is the record owner of the property. The other defendants are her husband, Duard Moody, and her brother, Charles Coe.
